Section 64: Punishment for rape

Offences Against Women and Children

gavel Statutory Legal Provision Text
(1) Whoever commits rape shall be punished with rigorous imprisonment of either description for a term which shall not be less than ten years, but which may extend to imprisonment for life, and shall also be liable to fine.

(2) Where rape is committed by a police officer, public servant, member of armed forces, person in management of hospital/institution, or against a pregnant woman, or causing grievous bodily harm, punishment shall be rigorous imprisonment for not less than twenty years, which may extend to imprisonment for life (remainder of natural life), and fine.
Prescribed Punishment
Rigorous imprisonment for not less than 10 years up to life imprisonment, and fine; Aggravated rape: minimum 20 years to natural life.
